The Answer
In this case, the Defendant was not served so he had 30 days to file his Answer. He did not know this though, so approximately 6 months later, he walked iinto the NYS Supreme Courthuose and found this out. Fortunately the Judgement had not yet been entered against him. If you are in this kind of situation in NY, You should go to the 1st floor of the Supreme Court and check in to the HELP CENTER. Its at 60 Centre Street in Manhattan.
File for E-File Capabilities
This will make your life easier if you have a phone/computer. Essentially if you are given a Court E-File account, that means you will NOT have to serve papers to the Plaintiff (or their attourneys) but can instead upload scans/pics of your documents to the NYS Court System portal. In any case, you still have to notorize whatever document you will upload. Fun fact: the ONLY free, yes free, Notary in all of NYC is in the basement of the Supreme Court in Manhattan (60 Centre Street). But the State of NY law has a max charge of $2, so find one near you if you cannot make it to south Manhattan). Note they are closed on Wednesdays.
